Justice Department Intervenes in Lawsuit Involving New Hampshire’s Mental Health System

WASHINGTON – The Justice Department today moved to intervene in Lynn E. v. Lynch, a recently-filed lawsuit alleging that the state of New Hampshire fails to provide mental health services to people with disabilities in community settings in violation of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973.  As a result of the state’s failures, people with mental illness who need state mental health services are forced to go to segregated institutions like the New Hampshire Hospital in Concord, N.H., and the Glencliff Home in Benton, N.H.

Under the ADA, a state cannot require people with disabilities to enter segregated facilities unnecessarily in order to get services.  In April of last year, the Department of Justice notified the state that it is violating the ADA by unnecessarily institutionalizing persons with mental illness and by failing to provide necessary community-based services and supports, like crisis services and housing supports.  Leadership within the state of New Hampshire has recognized that the state’s mental health system is deficient.  According to a top state official, “NH’s mental health system is failing, and the consequence of these failures is being realized across the community.  The impacts of the broken system are seen in the stress it is putting on local law enforcement, hospital emergency rooms, the court system and county jails, and, most importantly, in the harm under-treated mental health conditions cause NH citizens and their families.”

The state adopted a 10-year plan for improving its system, however, the state failed to implement important pieces of its plan and to put in place needed reforms to meet the needs of people with mental illness.  The New Hampshire Community Mental Health Centers association recently concluded that the state had failed to meet important benchmarks within its 10-year plan and informed federal officials that the New Hampshire community system “has less capacity in January of 2012 than it had in August of 2008 when the ‘Ten-Year Plan’ called for additional investment.”

“States are obligated by the ADA to provide services to people with disabilities in appropriate, integrated settings, so that they can live and work in the community, just like people who do not have disabilities,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division.

  “People with mental illnesses in New Hampshire are currently denied this right and are instead forced to receive costly services in inappropriate settings, like state institutions, as well as local hospital emergency rooms, rather than in more therapeutic and less expensive community settings.  With our efforts today to intervene, we hope to vindicate the rights of people with disabilities and prompt the state to take the necessary steps to meet their needs in more appropriate community settings.” 

“Individuals with mental illness who experience a crisis in New Hampshire often spend days in local emergency rooms that are ill-equipped to address their needs, at great expense, and are then transported to the state’s psychiatric hospital, sometimes by the police,” said John P. Kacavas, U.S. Attorney for the District of New Hampshire.  “This costly and traumatic process could be avoided if New Hampshire offered proven and effective services in the community to prevent and deescalate crises, help people maintain safe housing and assist them in finding and holding employment.”

For several months last year, the department engaged in talks with the state in an attempt to resolve the violations the department had identified.  However, the parties were ultimately unable to come to an agreement.  In order to vindicate the rights of people with disabilities under the ADA, the United States now seeks to participate in this lawsuit.  The plaintiffs in the case are represented by the Bazelon Center for Mental Health Law, the Center for Public Representation and the New Hampshire Disabilities Rights Center.

"Turns out the no-longer discreet dating service for married adults Ashley Madison [tagline “Life is short; have an affair”] was frequented by the Queen City’s municipal account.

Based on data analysis of users of the site, which was hacked earlier this week in a massive data breach, manchesternh.gov turns up 4 times, coming in at No. 326 out of more than 1,600 addresses gathered  by pastebin.com (see the full run-down below).

Mayor Gatsas said the matter is under investigation at City Hall.

“I was alerted to this information earlier today and immediately notified Jennie Angell, the Information Systems Director for the city. She is conducting a thorough investigation of the claim.

Through this investigation should we find the claim to be true, and there was gross misuse of city resources, it will be immediately turned over to the city solicitor", Gatsas said.


Other New Hampshire municipal government accounts that turned up in the pastebin.com search were Dover, Nashua, and Milford. Also cited: U.S. Postal Service, the White House ("had 42 accounts"), the Social Security Administration, NASA, and the U.S. House of Representatives.

Someone has some explaining to do.

Leaked Ashley Madison Data Includes NH Government Domains




At least seven New Hampshire government email domain addresses have been released as part of the Ashley Madison hack data breach fallout, according to posts online.


The hack also included domain names from military accounts as well as government accounts on the federal, state, and local level, according to a collection of the domains posted on pastebin.com.


In July, a group known as Team Impact vowed to hack into AshleyMadison.com and release the data of its members, who log profiles on to the site to seek out extramarital affairs. Team Impact succeeded this week, leaking hacked data from Ashley Madison and Established Men, both owned by AvidLife Media.


The files, according to Wired.com, included the information and logins for about 32 million users.

At least seven of the domains came from municipal government accounts in New Hampshire including one from Dover, four from Manchester, one from Nashua, and one from Milford.


Accounts include thousands with military domains as well as 52 connected to the U.S. Postal Service, 44 connected to the White House, 42 with the Social Security Administration, 28 with NASA, and numerous other government departments. At least seven were connected to the U.S. House of Representatives, according to the data dump.

We analyzed the leaked Ashley Madison data to determine the cities in New Hampshire with the most accounts.

Do you know a potential cheater in New Hampshire? Odds are that if you live in one of the cities below, you do. At least, you probably know someone who created an account on Ashley Madison, or had an account set up in their name by a friend or colleague.

There were over 32 million accounts created on Ashley Madison, and the going consensus is that almost all of them were created by men. In New Hampshire alone, there were over 57,689 accounts created, total. That's a lot, considering that the entire population of the state is 1,100,000.

After analyzing 126 cities, this is the list of the cities with the highest number of per capita Ashley Madison accounts in the Granite State:

How We Determined The Cheaters In New Hampshire

Want to know who is attempting to cheat? Go directly to the source of people actively trying to cheat — Ashley Madison users.

We used the Ashley Madison database to count how many accounts were created in each zip code. We are saying “accounts” and not “people” because it is possible to create dummy accounts assigned to a city or to have multiple accounts. However, we believe the number of accounts to be a solid proxy for the number of people trying to cheat.

We then matched each zip code to its corresponding city in New Hampshire. If a zip code falls into more than one city, the accounts registered in that zip code were applied to each city.
Finally, we used an estimate for the population of the zip codes to identify the number of cheaters per capita.

After identifying the number of cheaters per capita in a city, we ranked each place from highest number of cheaters per capita to lowest. The place with the most cheaters per capita “earned” the title of cheating central of New Hampshire.

Note: We only looked at cities with more than 2,000 people.

  • Men are more likely than women to have a sexual affair, regardless of whether or not they are in a marriAge or unmarried relationship
Note: Due to the secretive nature of infidelity, it is impossible to find the exact figures about cheating and extra-marital affairs. In many cases, infidelity never gets discovered.

Why the rate is getting higher?

  • Due to women entering the work force, there is a rise in cases of office romances and eventually rise in infidelity rate.
  • Internet and its increasing popularity have made it easier for people to engage in infidelity.
  • Jealousy is such a fundamental, universal emotion that can compel people to have a relationship with someone else.
